Hawaiian Electric’s New Year, New Phone Automatic Bill Payment Sweepstakes

OFFICIAL RULES

1. NO PURCHASE NECESSARY TO ENTER OR TO WIN. VOID WHERE PROHIBITED.
2. SPONSOR. Hawaiian Electric’s New Year, New Phone Automatic Bill Payment Sweepstakes (“Sweepstakes”) is sponsored by Hawaiian Electric Company, Inc. and its subsidiaries, Maui Electric Company, Limited and Hawai’i Electric Light Company, Inc. (collectively, “Hawaiian Electric” or “Sponsor”), whose decisions regarding the selection of winners and all other aspects of the Sweepstakes will be final and binding in all respects.
3. ELIGIBILITY. Subject to the additional restrictions below, the Sweepstakes is open to legal residents of the State of Hawaii who are 21 years of age or older at the time of entry, unless local law prohibits entry or requires pre-registration or bonding. Employees of Hawaiian Electric, its parent company, or any of their affiliates, subsidiaries, or advertising or promotional agencies, and the immediate family members of, and any persons domiciled with, any such employees are not eligible to enter or to win. The term “immediate family members” includes spouses, parents, siblings, and children.
4. HOW TO ENTER. The Sweepstakes entry period begins on January 13, 2026, at 12:01 AM HST, and ends on February 28, 2026, at 11:59 PM HST (“Entry Period”) and involves the entry methods described below. Details of the promotion are available at hawaiianelectric.com/newyearnewphonesweepstakes.
   
   All Hawaiian Electric customers who are enrolled in automatic bill payment at the end of the Sweepstakes entry period will receive one entry.
   
   Alternative method of entry is to mail a postcard, including your name, date of birth, phone number/email and complete address to: Hawaiian Electric’s New Year, New Phone Automatic Bill Payment Sweepstakes c/o AL22-QO, PO Box 2750, Honolulu, 96840. Each postcard must be mailed separately and must be postmarked between January 13, 2026 and February 28, 2026 and received by Tuesday, March 3, 2026. Photocopied, illegible, or mechanically reproduced entries are not eligible. All entries become the property of the Sponsor and will not be returned or acknowledged. Sponsor is not responsible for lost, late, damaged, misdirected or postage-due mailed entries.
   
   Entries are limited to one per household.
5. WINNER SELECTION. On or around March 5, 2026, Sponsor will select five (5) individuals in a random drawing from among all eligible entrants (individually, a “Winner” and collectively, the “Winners”).
6. PRIZES AND ODDS. Each Winner will receive a new 256 GB iPhone 17 with a retail value of $799 (“Prize”). The Prize is not redeemable for cash. The odds of winning depend on the number of eligible entries. Any reference to “Apple” and “iPhone” is solely for the purpose of describing such the prizes and is not intended to suggest any affiliation or sponsorship. Winners will be chosen at random using a digital randomizer to prevent any human error.
7. WINNER NOTIFICATION AND PRIZE ACCEPTANCE. Winners will be notified at the email address or associated with the Winner’s entry. Award of the Prizes is subject to verification of a Winner’s eligibility and compliance with these Official Rules. Sponsor’s inability to reach a Winner using the information provided, a Winner’s failure to timely respond to Prize notification, and/or a Winner’s failure to comply with any term or condition of these Official Rules may, at the sole discretion of Sponsor, result in that Winner’s disqualification, the forfeiture of his/her interest in the Prize, and the selection of a substitute Winner from among all remaining eligible entries. A Winner may waive his/her right to receive a Prize. Prizes are non-assignable and nontransferable. No substitutions allowed. Prizes are subject to availability, and Sponsor reserves the right to substitute Prizes of equal or greater value. Winners are solely responsible for reporting and payment of any taxes on Prizes. Winners may be required to complete an affidavit of eligibility and a liability and publicity release (except where prohibited by law), both of which must be returned within ten (10) days of the date of personal delivery or sender’s postmark. Failure to sign and return the affidavit and release within ten (10) days may result in the Winner’s disqualification, the forfeiture of his/her interest in the Prize, and the award of the Prize to a substitute Winner.
8. CONDITIONS OF PARTICIPATION. By participating, entrants agree to be bound by these Official Rules and the decisions of Sponsor. Except where prohibited, participation in the Sweepstakes constitutes each entrant’s consent to the Sponsor’s publication of the entrant’s name in any media for any commercial or promotional purpose, without limitation or further compensation. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this Sweepstakes as solely determined by Sponsor. In the event the Sweepstakes is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of Sponsor, which corrupts or impairs the administration, security, fairness or proper operation of the Sweepstakes, Sponsor reserves the right in its sole discretion to suspend, modify or terminate the Sweepstakes, or any portion thereof. Should the Sweepstakes be terminated prior to the stated expiration date, Sponsor reserves the right to award the Prizes based on the entries received before the termination date. Sponsor will not be responsible for incomplete, lost, late, misdirected or illegible entries, for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, telephone equipment, line or network, whether originating with sender, a third-party provider, or Sponsor. Third-party merchants and service providers are solely responsible for the quality and performance of any goods and/or services awarded as a Prize. Any rules of said merchants relating to the redemption, return, exchange, and/or expiration of such awards shall apply. Sponsor is not responsible for those portions of the Prizes provided by such third-party merchants. Sponsor shall not be liable for any bodily harm and/or property damage and/or lost opportunity which may result from this Sweepstakes or from the provision of the goods or services awarded as Prizes. All personal information collected by the Sponsor will be used for administration of this drawing. In addition, entrants may receive email correspondence from or on behalf of Hawaiian Electric to our privacy policy. Hawaiian Electric uses reasonable commercial efforts to comply with Federal CAN-SPAM guidelines, and entrants may subsequently opt-out of receiving further emails by following opt-out instructions contained in any such email.
9. GENERAL RELEASE. By entering the Sweepstakes, entrants release the Sponsor, its respective parent companies, affiliates, and subsidiaries, and their respective officers, directors, employees, agents and representatives from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Sweepstakes or with the acceptance, possession or use of any Prize or any travel, merchandise, or other goods or services redeemed with any Prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injury, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).
10. CONSTRUCTION. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and Sponsor, shall be governed by, and construed in accordance with the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules or provisions (whether of Hawaii, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than Hawaii. In the event that any dispute arises regarding the meaning or interpretation of these Official Rules, participants agree that the dispute shall be by and within the courts of the State of Hawaii and no other. The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
11.
